Motorola/Google Deal Gets OK-With a Warning

The deal gets approval but EU said it is watching

As expected both the EU and the United States Department of Justice have given Google’s $12.5 billion purchase of Motorola Mobility the go-ahead. At the same time the US approved the purchase of Nortel wireless patents by an Apple-Microsoft led consortium.

From the outside it looks like this sets up a battle royal in the patent space as both now are armed with a host of additional patents and the players on both sides have shown a very ready willingness to go to court to enforce them.

Apple has been strongly going after a number of Android smartphone developers, in particular Samsung, HTC and Motorola. Motorola has been returning fire at Apple, with Google’s approval, while https://www.microsoft.com/Presspass/press/2012/jan12/01-12LGPR.mspx has been quietly but efficiently getting developers’ to pay it for select patents.

However hopefully we will not see a yearlong battle in this space, something that could temporarily blunt the strong growth of smartphones and tablets. No one wants what happened in the last years of dial up modems when conflicting technologies made for incompatibility.

According to a careful analysis of the agreements published in Foss Patents, Florian Mueller said that the approvals are not without caveats. The EU said specifically that it will be looking at future and past enforcement of patents by Google and that it is ready, willing, and able to step in if it believes they are being abused.

He said that the end result of these deals will be business as usual, which currently means a series of lawsuits working their way through court. At the same time he notes that just because no action has been taken to date does not mean that none is forthcoming.

From the European Commission’s press release announcing approval is this important paragraph. “Today’s decision does not mean that the merger clearance blesses all actions by Motorola in the past or all future action by Google with regard to the use of these standard essential patents. Our decision today is without prejudice to the legality under EU antitrust law of Motorola’s past and Google’s future actions. However, the question whether Motorola’s or Google’s conduct is compliant with EU antitrust law cannot be dealt with in the context of the merger procedure.”

So while it may be business as usual in the short run, the court cases could result in the addition of another player, and one that has a lot more clout than any of the individual players involved, or all of the players for that matter.

Friday Grab Bag: Microsoft talks Windows 8 Tablet

The top Windows exec at Microsoft, Steve Sinofsky, has published a huge blog entry that details Microsoft’s plans for Windows 8 on low-powered platforms driven by processors built around the ARM processor technology.

Since that is the primary chip technology driving most tablets, this blog entry shows how the company sees the space and what it believes it can bring to the market that its rivals cannot, or are not doing well.

A few of the key talking points are that versions of Windows for ARM platforms will carry a Windows for ARM branding; there will be a special version of Office for this platform and there will be a major effort to have the hardware and software tightly integrated, much like Apple does with the various iOS products.

Phoenix Suns latest to grab tablets as in-game tool
If you happen to watch closely the next time you are viewing a Phoenix Suns game expect to see branded products from Samsung and Verizon Wireless on the sidelines in place of the old school chalkboards.

The team has signed a deal that will provide the players, scouts and coaches with Samsung Galaxy 10.1 Tab tablets and Verizon 4G wireless service. The team plans to use them for a winde variety of tasks including in-game play calling by head coach Alvin Gentry.

While the NFL and Major League Baseball have been very aggressive in developing and deploying tablets as part of a training regime the NBA has lagged behind. This is probably going to be watched very closely and probably imitated by a number of other teams in the off season.

Asus admits bug in Transformer Prime
Asus has released a firmware update that will fix the random boot problem that has plagued some but not all owners of its Eee Pad Transformer Prime Tablets. The move comes after a flow of negative comments on line and at least one retailer, UK’s Clove to cease selling the product.

The tablet has had several flaws since it was debuted last year including simple lack of product available and a GPS accuracy issue. In the past the company has denied that there was a reboot issue but has now finally admitted it.

Patent Wars
Apple continues to battle and seems to be losing ground at a slow and steady rate. Its latest setback was a German court ruling that Samsung Galaxy Tab 10.1, called the Galaxy Tab10.1N in the German market does not appear to be a copycat version of the iPad.

Apple had won an initial ruling preventing Samsung from selling n the German market last September and the 10.1N is a work around that has been found acceptable by the court, reopening the market to the Apple rival.

Apple has been particularly aggressive pursuing Samsung in both the iPad but also iPhone space claiming that it carefully copied its devices. So far its success has been lackluster in courts but that does not seem to have changed Apple’s determined drive in the patent space.

Google’s bid for Motorola Mobility likely to be approved next week
Multiple sources are reporting that the $12.5 billion purchase of Motorola Mobility by Google will get antitrust approval from the United States Justice Department sometime next week. Among other assets that Google will acquire is a patent portfolio that is 17,000 strong in the mobile phone area.

This patent portfolio is likely to be used for both offensive and defensive purposes by the company. It is aggressively seeking huge payments from Apple over all iPhone and other iOS devices, but will likely also be used to simply be leverage in cross patent licensing agreements.

At the same time the Justice Department is likely to approve of the purchase of Nortel by a consortium of Apple, Microsoft Sony, Research in Motion, EMC, and Ericsson AB. This deal will include 6,000 wireless patents.

Pending Google Tablet to rival Kindle Fire?

Multiple reports are claiming that the long pending tablet from Google will be targeted more at the Kindle Fire market than the iPad market. While there is some overlap in the two markets currently I see them as serving different groups of primary users, although that will change.

The Google Tablet is expected to be in the 7-inch form factor and will have a $200 price tag upon its expected delivery in late March or early April. The web company is expected to first create a web site that is designed to specifically cater to expected customers of its Android-powered tablet and will make apps. Movies, books and music will be made available at that site.

This will make an interesting battle as Google’s deep pockets and ubiquity of its browser will enable it to reach a wide audience via advertising on its pages as well as in other media. A similar thrust by Barnes & Noble for its Nook has cost that company dearly but the impact for Google should be significantly less due to its much greater resources.

Twice as many Americans own 4 TVs as opposed to 1
The latest State of the Media: Consumer Usage Report from Nielsen has a number of interesting facts across the broad markets that it surveyed, with the one quoted above being just one of them.

The number of people age 13 and older that own a mobile phone is fast approaching the number of people that own at least one television- 232 million to 290 million. Satellite did much better than I had expected when compared to digital cable- 95 million compared to 145 million.

TiVo Delivers Android version of its App

TiVo has had an app for customers using products powered by the Apple iOS and has now greatly expanded its audience with the delivery of the app for the vast Android space as well, according to a piece in Cnet

The free app is designed for use with both smartphones and tablets and enables a user to participate in social media such as Facebook and Twitter while viewing programs that are currently playing from a TiVo box.

TiVo has also announced that it has settled pending patent litigation with AT&T. In the deal AT&T has agreed to a mutual patent licensing agreement and will be making payments to TiVo that include an initial payment of $51 million and reoccurring payments that will run until June, 2018.

Apple files for patents that cover photos and fitness.
Patently Apple has reported that Apple has won patents for Photo Booth and a sports related one that covers a fitness center app. The site has a great deal of information of the Fitness Center App and said that it covers a range of issue facing exercisers including motivation and how to use equipment.

Apple also appears to have a range of additional related patent claims pending that could help it gain a strong presence in this market, or a future in additional litigation as others imitate its direction. I wonder how all of the makers of fitness apps in the iTune store feel about this?

Additionally Apple has been awarded a patent for Photo Booth so that users of Apple devices, initially just the iPad but expected to cover both other iOS devices’ as well as OS X products to manipulate images that have been taken with the devices’ built-in camera.

Other Apple News

Apple has also filed for a pair of patents that indicate that it is seeking to develop a hydrogen fueled battery that it is speculated could power its devices for weeks between recharges. I would be happy to make it through the day right now.

According to the latest from iLounge new code found in the iOS 5.1 release points to a future that has devices powered by quad-core chips. The site said that it believes that products with quad-core chips could be delivered as early as March of this year.

No Chrome Browser for Mac Users Watching NBC Online

We are as excited as anyone about the launch today of NBC’s new all-sports network but if you want to watch the NHL Classic outdoor game on your Mac computer, you won’t be able to use Google’s Chrome browser according to an error message generated by the NBC site.

Since you probably already have either Firefox or Safari loaded somewhere on your machine it’s probably not a big deal but if you are experiencing difficulties, Mac fans, this is why. We will be watching some online to see how the multiple camera-angle things and DVR functionality work out. UPDATE: Watched a little bit of the game — the different camera angle thing was fun but wow, NBC, couldn’t you wait with the pop up ads? Two in just two minutes of watching. Plus, I thought the Twitter challenge and social-media window on the right wasn’t prominent enough to stand out. Think the whole thing needs a full-screen revisit before the Super Bowl.

Facebook, Twitter in Death Match Over Sports Fans’ Souls

If Facebook bought Twitter, sports fans would rejoice.

Through such a fantasy merger, there’d be only one “identification service” to worry about when you wanted to broadcast your sports opinions to the world. That would be a welcome relief from the two-headed monster that now rules the kingdom of sports smack, the beast with tweets on one side and Facebook posts on the other. The big question is whether sports fans will continue to feed both monsters, or whether one will prevail, like Highlander, to rule them all.

Winning the ID Game

Before we get too deep into bad movie cliches, it’s worthwhile to take a small step back and wonder at how quickly Facebook and Twitter have basically won the battle for user identification, or authentication. In the days of Grampa Internet, individual sites would try to get readers to “log in” or “register” with unique passwords and IDs. That led to a frustrating era, just now ending, of having to remember multiple screen names, logins and places to track conversations.

Then came Facebook and Twitter, who after a short while made the smart move of making users’ identifying features portable — meaning you could use your Facebook or Twitter screen persona to log in to web sites and blogs, instead of having to remember each site’s unique ID. Boom, game over. If you are an active sports commenter, you are probably already on Facebook and Twitter and spend little time anywhere else.

Though ESPN still requires you to have a site-specific login to comment on their story “conversation” sites, it’s easy to see where the worldwide leader is going, with constant beckonings to “tweet us your questions” to be answered on talk shows, and with an unending parade of Facebook polls and comment come-ons. It’s pretty amazing that two startups like Facebook and Twitter could completely trash the user-ID-accumulation schemes cooked up by major media properties since the web began. What might be more compelling is the coming clash between the two new titans, who each have attributes that make them more compelling to sports opinionators, depending upon the situation.

Twitter: Fast, fun and the athlete’s domain

Though by far the smaller of the two services, Twitter is the new darling of the sports world, in no small part because it has become the favorite platform for pro athletes. Unlike a website, a blog or even a Facebook page, a Twitter account needs only some short thoughts and a smartphone — two things that are front and center in the pro athlete’s world of 2011.

In its short life Twitter has changed the face of many facets of media production, including coverage of wars and revolutions. In the less-meaningful but not less-followed world of sports, Twitter has become the de facto news wire of the sporting world, with teams, athletes, fans and followers all adding to and taking away from the information stream.

For the average fan, Twitter is like a fire hose of comments and information that never slows down, and is as wide and diverse as who you choose to follow. From a commenter standpoint there is the problem of having to make your voice heard in the crowd, but by just signing up and tweeting you still have a chance to see your name or fan-tastic psuedonym flashed on the ESPN screen. The low barrier to entry and instant gratification make Twitter the first choice for a lot of new Internet sports enthusiasts.

Facebook: Best for long opinions, monetization

In terms of really building an online social presence, however, nothing beats Facebook, especially when it comes to easily finding a home for photos, videos, long opinions and opportunities to build a business. For teams, athletes, vendors and sponsors in the field, a Facebook page is a no-brainer as it gives easy access to the hundreds of millions of folks who already have a Facebook ID.

For the average sports fan Facebook is probably a lot easier to understand than Twitter, and the post/comments structure lends itself to longer “conversations” on a single topic or event. The recent integration of Facebook comments under blog posts is a step toward Facebook’s plan of social-activity domination: Simply put, the service wants to make it easy for you to record your every thought, “Like” and observation in some form that can be embedded inside a Facebook wrapper.

And by allowing integration of applications and even stores on Facebook pages, the service is equally attractive to teams, vendors and sponsors who want to extract dollars from the multitudes of fans. The commerce-friendly platform is what gives Facebook the sporting edge right now, but Twitter is gaining ground quickly, thanks to its Google-like ease of use.

Who Wins? Or do they both survive?

Right now, connected sports fans as well as athletes, teams, schools, advertisers and vendors in the sports-fan space all are most likely active on both services, depending on the time of day or situation. While much of the live commenting action has moved to Twitter thanks to its instant-publishing stream of thought, the more leisurely searches for information and interaction still take place on websites, blogs or Facebook pages, meaning that you can’t live on simply one or the other right now.

While that means there is still the headache of “do I post to Twitter or Facebook,” there remains the possibility of some future integration, perhaps by a business arrangement once both firms go public as is widely expected. Though there do exist services and techno-solutions that will replicate your Facebook posts onto Twitter and vice versa, the different styles of communication on either platform make such services an inelegant compromise at best. Will those differing styles keep the beast’s two heads alive indefinitely, or will one succeed in chewing through the other’s throat? Whichever way it goes, it will be a fun movie to watch play out over the near term future.

Friday Grab Bag: Pre Black Friday Issue

Site takes you on Stadium Journey
Every year or so you see a story about some intrepid fans that are going to travel around the US and visit all of the ball parks during baseball season. A bit rarer but you also see people that try to hit all of the minor league fields on occasion.

Well if you are just an armchair traveler, or looking to do research about a sporting venue prior to leaving home then the folks at Stadium Journey have the site for you. Sure it covers all of the MLB parks with solid info and interesting photo montages, but that is the tip of the iceberg.

How about the Central Hockey League arenas? Or are you headed to Europe and want to see what Old Trafford, the home of Manchester United looks like before attending? Its there and much more. Of course there are gaps in its lineup, particularly in Europe and possible elsewhere (I did not carefully check each league) but it is a fun and informative site. One comment- in its AT&T review it mentions “blistering Candlestick”- try freezing Candlestick.

EA’s Twitter Campaign gets Results
Electronic Art’s decided to use a sponsored Twitter to promote its FIFA 12 video game several months ago it found that the social media site, couples with a focused time-sensitive ads brought solid results, 5%-8% higher than normal for Twitter-based campaigns.

The program had a 11% customer engagement was due to what EA said was its ability to take advantage of the traffic generated by the ads and so turn it into both sales but increased following for EA’s normal Twitter feed, thus setting up potential future sales as well.

For those of you that are scratching your head and wondering what FIFA is, it’s the The Fédération Internationale de Football Association (International Federation of Association Football) that hosts the World Cup every four years. You know, soccer.

Facebook is seeking another avenue into your soul
Rumors have it that Facebook is teaming with Taiwanese cellphone developer HTC to develop a customized Android-powered smartphone code-named ‘Buffy”. Buffy, really? This rumor is according to the blog All Things Digital.

The reason is clear why Facebook would want to move further into the mobile space, it already has 350 million mobile users and relationships with a huge number of mobile operators across the globe. Still this just brings the ESPN phone back to my mind.

However don’t hold your breath waiting to use this phone to poke your friends- Facebook still has a ways to go including signing carriers, designing and then building the devices so it is not expected for at least 12- 18 months.

Top iPhone Games-No football?
Ever wonder what sports apps you should have loaded on your iPhone, assuming you have an iPhone, so that when you finally tire of shooting birds at pigs while sitting in an airport lobby you can have something else to do?

Well a short list has been created at appolicious advisor, which brings in 5 programs that it touts as timeless- thus eliminating from consideration season focused apps such as SEC Football lite or NBA 2011-12 (is there such an app?)

The five that made the cut include Bill James Baseball IQ, ESPN Radio, PrePlay, Tiger Woods: My Swing and Yahoo Spectacular. Anybody have an issue with this or what they fell is better choices send them my way and maybe I will follow up with fan favorites.

Is Malware a threat on Android?
Google is in a verbal fight with at least one security expert over the threat that viruses and other malware present to the Android mobile operating system, according to a recent post at ITWorld.

On the one hand we have Google’s open source program manager Chris DiBona claiming that the virus and security software companies are a buch of charlatans and scammers and there is no problem.

On the flip side there is Denis Maslennikov, a senior malware analyst for Kaspersky Labs who claimed that the number of malware discoveries on Android has been growing and that in less than half a year the number has rapidly grown.
